    Umbrella Mitigation Banking Programs (UMBP) are one of several practicable options available to applicants to compensate for unavoidable impacts to waters of the United States that are associated with permits issued under the authority of Sections 404 and 401 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899. The accompanying WFI-B UMBP prospectus outlines the circumstances and manner in which this program will provide a compensatory mitigation option to permit applicants under the Corps of Engineer’s permit program. The use of the WFI-B UMBP to compensate for unavoidable impacts to aquatic resources is a decision of the Corps of Engineers and there is no guarantee that any individual or general permit will be granted authorization because of proposed use of this UMBP. Therefore, the Sponsor is seeking approval of the WFI-B UMBP from the Inter-Agency Review Team (IRT), which is composed of representatives from the U.S. Army Corps of Engineers (USACE), Missouri Department of Natural Resources, Missouri Department of Conservation, the U.S. Environmental Protection Agency, and U.S. Fish and Wildlife Service.

    The U.S. Army Corps of Engineers, St. Louis District (the Corps) issued a public notice in February 2023 soliciting comments on the proposed reissuance of general permit for routine maintenance of existing stormwater, sanitary, and combined sewer systems. We have reviewed all comments and made minor changes, resulting in the approved St. Louis District Regional General Permit 44 (MVS-RGP-44). With this notice, the Corps is announcing the immediate availability of MVS-RGP-44 for use by applicable public utility entities, subject to guidelines and conditions contained therein. The Corps has limited the area in which MVS-RGP-44 may be used to local municipalities and public stormwater system authorities.

    The applicant, Port Charles Harbor, is an existing harbor facility which offers wet/dry slips, mechanical & refinishing service, boat restoration, and a ship store. The applicant seeks authorization to conduct maintenance dredging operations within the harbor, as multiple high water events, specifically the flood event of 2019, have caused the re-deposition of fine materials within the harbor. Previous permitting authorized the construction of the harbor, as well as subsequent permitting that authorized the placement of materials into the Mississippi River in an open water disposal site just outside the harbor’s mouth. The project purpose is to reissue the maintenance dredging permit previously authorized to maintain the harbor in such a condition that recreational vessels have a safe ingress and egress to the site. The proposed dredging will only remove material deposited by the river and will not alter the previously authorized contours of the Harbor. The applicant seeks reauthorization to continue with periodic maintenance by placing dredged material into the river just outside the harbor entrance at river mile 221.5. The project is located on the right descending bank of Mississippi River at approximate mile 221.5, St. Charles County, Missouri. Specifically, the project is located on the Grafton USGS quadrangle maps, Section 08, Township 48 North, Range 5 East. The Public Notice comment period is open from June 13, 2023 through July 05, 2023.
