The applicant seeks authorization to conduct grading and filling operations in waters of the United States for the construction of gate closure structures associated with two proposed flood wall/levee projects. The project is to occur along two separate stream channels that flow through the City of Eureka, St. Louis County, Missouri. The first stream channel, Flat Creek, is located to the south of I-44 and flows through the City park as well as near the historic district. The second channel, Forby Creek, is located to the north of I-44 and flows along residential properties and Eureka High School. The City of Eureka (City) is proposing to construct a floodwall along Forby Creek (known as the North Levee) and another along Flat Creek (known as the South Levee). The applicant stated that the purpose of the project is the protection of existing homes, buildings and infrastructure from further flood damages. The applicant seeks authorization to conduct grading and filling operations in waters of the United States in order to construct a mixed-use (office, retail, & residential) development, with associated infrastructure, in order to provide economic development and multi-modal transportation options to complement existing development within St. Charles’ historic Main Street and Streets of St. Charles, while serving as a connection between these areas and the Family Arena to the southwest. Proposed project plans include the construction of a retaining wall parallel to Crystal Springs Creek/Bangert Slough, and grading/filling behind it to facilitate construction. The project proposes to impact 15.5-acres of forested wetland, 975 linear feet of perineal stream, & 376 linear feet of intermittent stream for the development. The wetland is located within the floodplain of the Missouri River, along the left descending bank. The wetland is also adjacent to, and inundated by, Crystal Springs Creek due to its connection to the Missouri River.

Effective September 11, 2020, the “Clean Water Act (CWA) Section 401 Certification Rule” (85 Fed. Reg. 42,210 (July 13, 2020) was implemented nationwide. The Rule (codified at 40 C.F.R. Part 121) establishes procedures that promote consistent implementation of CWA Section 401 and regulatory certainty in the federal permitting process.The Corps Districts in Illinois have developed procedures for the public to submit Department of the Army (DA) Permit Applications and associated WQC requests electronically. This notice details those procedures.

MO Nationwide Permit Proposals

On September 15, 2020, the U.S. Army Corps of Engineers (Corps), published in the Federal Register its proposal to reissue the 52 existing Nationwide Permits and issue five new Nationwide Permits. Nationwide Permits (NWPs) are general permits issued on a nationwide basis to streamline the authorization of activities that result in no 0002 more than minimal individual and cumulative adverse environmental effects. The Federal Register Notice is the public’s opportunity to comment on the proposed NWPs, general conditions, and definitions. Due by November 16, 2020. Comments on national issues relating to these NWPs should be submitted to docket number COE-2020-at www.regulations.gov, or by email to nationwidepermits2020@usace.army.mil, or by mail to Headquarters, U.S. Army Corps of Engineers, Directorate of Civil Works, ATTN: CECW-CO-R, 441 G Street, N.W., Washington, D.C. 20314-1000. Instructions for submitting comments are provided in the September 15, 2020, Federal Register Notice. The St. Louis District is seeking comments (due by November 16, 2020), on the proposed Regional Conditions and seeking comments on the need for additional Regional Conditions to help ensure that the adverse environmental effects of activities authorized by the proposed NWPs are no more than minimal, individually and cumulatively. Unless otherwise noted, all proposed Regional Conditions listed on this enclosure are applicable for activities in Missouri. Comments on regional issues relating to the proposed NWPs and proposed Regional Conditions should be sent to Kansas City District, Missouri State Regulatory Office, 515 East High Street, Suite 202, Jefferson City, Missouri 65101, or by email to james.s.reenan@usace.army.mil. RGP 45

The U.S. Army Corps of Engineers, St. Louis District, HAS ISSUED GP-45, authorizing the discharge of dredged or fill material associated with activities designed to improve water quality, improve fish and wildlife habitat, maintain recreational value, and extend the lifespan of man-made lakes and ponds. This permit authorizes the removal and discharge of lakebed/pond sediment in conjunction with mechanical dredging, hydraulic dredging (including return water from such activities) and excavation activities. The use of standard construction equipment to remove accumulated sediment is authorized by this permit. The dredged/excavated material may be used in the construction of jetties/breakwaters, shoreline stabilization structures, fish and wildlife habitat improvement structures and other similar activities. This regional general permit is issued under the authority of Section 404 of the Clean Water Act (33 USC 1344). It does not obviate the need for project proponents to obtain other Federal, state, or local authorizations. DURATION OF THE GENERAL PERMIT: The GP-45 has been issued and is in effect for a period of five years from the issue date of (September 29, 2020), unless it is specifically modified, suspended, or revoked prior to the expiration date.
