The St. Louis District, U.S. Army Corps Of Engineers Permits Office Open Public Notices
P-2817:The Southwestern Illinois Flood Prevention District Council (SIFPDC) in cooperation with the Wood River Drainage and Levee District, Metro-East Sanitary District and the combined Prairie du Pont Drainage and Levee District/Fish Lake Drainage and Levee District seeks authorization to perform levee improvements on the three aforementioned Metro East Levee Systems in order to restore the level of protection to a 100-year certification provided by the respective Drainage and Levee District’s such that the levee system will be eligible for accreditation in accordance with 44 CFR 65.10 criteria. A total of 26.36 acres of wetlands and waters of the United States will be impacted as a result of the construction improvements. The St. Louis District Environmental Compliance Branch has prepared an Environmental Assessment and Draft Findings of No Significant Impact for the project. The applicant has prepared a draft compensatory mitigation plan for unavoidable impacts as a result of the project. The project is located in Madison, St. Clair and Monroe Counties, in southwestern Illinois. The Public Notice comment period opens January 20, 2012 and closes February 20, 2012. P-2815: The applicant, Laclede Gas Company, proposes to enclose 490 linear feet of an unnamed tributary to Deer Creek at their Shrewsbury facility. The project is proposed to address severe down-cutting and erosion of the channel. The erosion threatens the adjacent industrial property. The public notice opens for comment on December 27, 2011 and closes for comment on January 17, 2012.
P-2813: The City of Highland seeks authorization to construct an approximate 3.3 acre retention pond and 0.5 acre sedimentation pond as part of a new park development. The new park will include a multi-use path, wetland education area, botanical gardens, a fountain centrally located in the pond, restrooms and parking area. The purposes of the park and facilities are to reduce flooding downstream, capture sediment and filter pollutants to benefit drainage into Sugar Creek and provide recreational opportunities. The project will impact approximately 440 ft of ephemeral stream and 0.55 acres of tree removal. In addition to the environmental designs of the ponds and park area, the proposed Mitigation Plan includes tree plantings in two locations at the rate of 109 trees per acre. The park will be located northeast of the intersection of Trestle Road and Iberg Road, City of Highland, Madison County, Illinois. More specifically, the project is located in the Southeast ¼ of the Northeast ¼ of Section 33, Township 4 North, Range 5 West, Third Principal, Meridian. The Public Notice comment period opens November 18, 2011 and closes December 9, 2011.
P-2814:Project Description: The City of Louisiana, Missouri seeks authorization under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act to construct a rock wind dike creating a small harbor which will contain floating dock structures along the right descending bank of the Mississippi River at mile 282.7. The wind dike will start at the right bank of the river and extend out seventy-five feet, slightly angling downstream. The dike will then turn and extend another one-hundred feet downstream, paralleling the river bank. The applicant will use A-stone rip rap with a top size of five-thousand pounds. Once the wind dike is constructed a floating metal boat dock structure with wood decking will be constructed inside the wind dike harbor. The dock structures will be secured by spud poles so they may rise and fall with fluctuating river levels. Additionally, a ramp will be placed from the adjacent parking lot owned by the City of Louisiana and the Missouri Department of Conservation, and then secured to the floating dock structures for access. The site is located along the right descending bank of the Mississippi River at mile 282.7. The proposed project will provide boaters with a safe harbor for docking their boats thereby giving them access within walking distance to all the amenities of downtown Louisiana. The applicant anticipates that the project will aide in stimulating the local economy while increasing the exposure to the City of Louisiana.
P-2812:ADM Grain Company has submitted an application for a section 10 permit to conduct periodic maintenance excavation in within an approximate 800-feet-long by 300-feet-wide area, situated within their existing barge loading facility on the Mississippi River at approximately mile 177.5 in Sauget, St. Clair County, Illinois. A clamshell excavator would be utilized to remove silt, sand, clay, and rock. The excavation would be conducted to maintain approximately 12 to 15 feet of river depth in the barge loading area. Excavated material would be loaded into contained hopper barges and delivered to the bank for offloading onto trucks. The material would then be transported by a universal waste disposal company to an upland landfill. The public notice opens October 31, 2011 and closes Nov 20, 2011.
P-2811: ADM Grain requests Section 10 authorization to conduct periodic maintenance excavation within their existing barge loading facility. The permit is requested for emergency excavation needs or during extreme low river conditions to allow for continued operations. The project is located at ADM Grain’s existing river terminal, along the right descending bank of the Mississippi River at approximate river mile 184, in St. Louis County, Missouri. The public notice comment period opens October 28, 2011 and closes November 17, 2011.
Missouri Regional Conditions for 2012 Nationwide Permits: On March 1, 2011, the St. Louis District issued an initial public notice of the proposed regional conditions to ensure activities authorized by the proposed 2012 Nationwide Permits result in no more than minimal individual and cumulative adverse effects on the aquatic environment. Based on public comments received and subsequent agency coordination, we have modified the initial version of the regional conditions. Specifically, we have added two new regional conditions. One new condition applies to NWP 23 and one applies to listed waters that provide habitat for sensitive aquatic resources. Additionally, we have made revisions to other regional conditions, including Regional Condition 1 for stream crossings. P-2699-2: The city of Wentzville proposes to construct an approximate 7-acre lake. The lake is proposed to manage stormwater runoff from adjacent developed properties. Stormwater management is necessary to alleviate residential flooding downstream of the proposed lake site. Construction of the lake will impact approximately 1,755 linear feet of ephemeral and intermittent tributaries to Dry Branch Creek. Dry Branch Creek is tributary to McCoy Creek, a tributary to the Cuivre River and the Mississippi River.
P-2810: Public Notice P-2810, Cahokia Creek, Roxana Landfill, Madison County, Illinois. The Roxana Landfill has requested Section 404 authorization to relocate three unstable sections of Cahokia Creek, adjacent to Roxana Landfill, west of Edwardsville, Madison County, Illinois. The applicant proposes installation of three channel blocks in the existing channel and construction of three new sections of the channel. The new channel will incorporate natural channel designs including stable meandering bends, channel structures, bank stabilizations and vegetation plantings. The new channels will improve Cahokia Creek water quality and bank stability. The new riparian corridor and channel structures will serve to mitigate effects of the channel blocks. P-2809: Fred Weber Inc., requests authorization to upgrade their existing Crystal City Sand facility. Proposed improvements include installing three (3) 25-foot diameter steel sheet pile cells and one mooring dolphin with a 30-inch diameter. A 40-foot by 200-foot dock barge would be permanently moored between the proposed sheet pile cells. An existing conveyor would also be permanently relocated to convey sand from land-based sources to the center of the dock barge. The proposed facility upgrades would occur along the right descending bank of the Mississippi River, at approximate river mile 149.9, in Section 32, Township 41 North, Range 6 East, in Jefferson County, Missouri. P-2807 and P-2808: Southern Illinois Transfer, Inc., requests authorization to relocate two existing barge fleeting areas riverward, near their current fleeting locations due to required dike construction activities being conducted by the St. Louis District Corps of Engineers. P-2803:The applicant, U.S. Army Reserve 88th Regional Support Command, seeks authorization to impact approximately 0.70 acres of wetlands to construct a new Army Reserve Center on the Weldon Spring Local Training Area (LTA). The proposed new construction will replace an outdated facility that no longer meets the current soldier training and readiness requirements. The 10 acre project area is located within the 1600 acre Weldon Springs US Army Reserve LTA at 7301 South Highway 94, St. Charles, Missouri. The site is approximately 30 miles west of St. Louis and is north of State Highway 94 and south of Highway D. Section 6, Township 45 North, Range 3 East. The wetlands flow to an unnamed tributary that continues to Schote Creek, which flows to Dardenne Creek, a primary tributary to the Mississippi River. P-2804: SCF Fleeting LLC seeks authorization to establish a fleeting area immediately adjacent and downstream of their approved loading dock. The fleet would be comprised of a maximum of 15 standard sized hopper barges (35-feet by 195-feet) configured in a 5 wide by 3 long arrangement. The fleet would measure approximately 175-feet-wide by 600-feet-long and would be situated near the shoreline. The riverward most portion of the proposed fleet would be approximately 600 feet from the centerline of the levee road. The fleet would be secured with chains and fleeting wires connected to upstream and downstream deadman structures that would be constructed in the adjacent bankline. The proposed fleet would be located along the left descending bank of the Mississippi River, at approximate river mile 181.0, near North Front Street, in East St. Louis, Illinois 62201. P-2805: The applicant, Prairie Coal Company, LLC, proposes to construct an underground mine located approximately 7 miles west-northwest of Pinckneyville, north of Route 13, Perry County, Illinois. The proposed Lost Prairie Mine project is an underground coal mine utilizing conventional room and pillar mining methods to extract the Herrin No. 6 coal seam. The surface facilities will include roads, a rail loadout and transport system, coal and soil stockpiles, coal refuse disposal facilities, preparation plant, and an office/maintenance building with parking area. Impacts to Waters of the United States are anticipated, and the applicant proposes compensatory mitigation for the impacts to jurisdictional features. P-2802: (revised)Green Energy Holdings LLC seeks authorization to construct a carbon recovery operation at a site about 2 miles east of Cutler, Perry County, Illinois. The proposed permit area is approximately 355.9 acres. The product will be reclaimed fine coal from the slurry remnants deposited by the Consolidation Coal Company's former Burning Star 4 surface mine. The operation and associated surface facility within the proposed mine permit area is expected to cause unavoidable impacts to 33.47 acres of wetland and 54.76 acres of deep water habitat. The post mine reclamation plan will include the restoration of deep water habitat (67.04 acres) and wetland (38.75 acres). The Public Notice opens August 17 and closes August 31, 2011
P-2800: The applicant, Drury Southwest, Inc., seeks authorization to conduct grading and filling operations in jurisdictional waters of the United States to reroute an existing section of unnamed tributary to Ramsey Branch. The proposed relocation would allow for commercial development of the property. The property currently contains a warehouse and sign company, located in the southeast section of the site. Approximately 1,770 linear feet of the existing tributary is proposed to be filled and rerouted. The applicant plans to excavate approximately 30,200 cubic yards of clay soil material from the new channel location and dispose of it in the existing channel. The project is located at 826 Fox Lane Drive, in the City of Cape Girardeau. More specifically, the project is located in Section 11, Township 30 North, Range 13 East, Cape Girardeau County, Missouri. The public notice comment period opens August 12 and closes September 2, 2011.
P-2801:  The Corps of Engineers proposes to correct a deficiency in the design of underseepage controls in the Wood River levee system, Madison County, Illinois. The recommended plan consists of various underseepage control measures, including 94 new relief wells; three small pump stations; 815 linear feet of seepage berms; 2,910 linear feet of slurry trench cutoff wall at the riverside levee toe to bedrock; 3,935 linear feet of shallow (25 ft deep) cutoff wall at the riverside levee toe; 1,010 linear feet of 5 foot thick landside clay fill; about 10 acres of flowage easements; and other appurtances. The plan would include unavoidable impacts from berms, relief wells, cutoff walls, and temporary access easements. The unavoidable impacts would cause direct losses of 2.9 acres of wetland habitats and 2.1 acres of non-wetland habitats. The mitigation plan would establish a total of 4.9 acres of wetland and 0.7 acres of non-wetland mitigation lands (total 5.6 acres) to offset unavoidable project impacts. There will be about 14 acres of prime farmland permanently converted to non-agricultural use. P-2760: Anchor Yankers , has submitted an application to remove 2000cy of sediment from the entrance to the back of the island on the left descending bank of the Mississippi River at approximately mile 225.2 in Calhoun County, IL. The material will be removed to allow navigational access to their facilities at this location. The material will be removed using a long reach trackhoe on a barge and the material will be put in a container on the barge before being placed behind a bullnose revetment on the northeast end of the island to speed accretion of material since the Corps of Engineers placed the revetment to slow erosion on the island. The material will be placed in conjunction with a NWP 27. The public notice comment period opens July 19, 2011 and closes August 9, 2011.
P-2799: The applicant, Missouri Conservation Heritage Foundation is a registered not-for-profit corporation in the State of Missouri and has been operating an existing ILF mitigation program, entitled the Stream Stewardship Trust Fund (SSTF), in partnership with the Missouri Department of Conservation for eleven (11) years under a Memorandum of Understanding with the Corps of Engineers. The sponsor is proposing revisions to their existing program that will bring it into compliance with the 2008 regulations governing compensatory mitigation (Mitigation Rule). The ILF program would be one of a number of practicable options available to applicants to compensate for stream impacts authorized under the authority of Sections 404 and 401 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899 within the State of Missouri. P-2798: The St. Charles County Dept. Parks & Recreation seeks authorization to impact approximately 1,100 linear feet of unnamed tributary within Broemmelsiek Park. The majority of impacts are associated with the creation of an approximate 2-acre sediment forebay for Betty's Lake. Construction of the forebay will require grading and associated loss of approximately 685 linear feet of two unnamed tributaries to Kraut Run Creek. The project also proposes the construction of a recreation access road, to be located south of the proposed forebay. The access road will cross both tributaries via culvert enclosures. The proposed road crossings will impact approximate 415 linear feet of the two tributaries. In general, the purpose of the project is to enhance the public recreation potential within Broemmelsiek Park. The existing Betty’s Lake is currently drained, and is proposed to be excavated to enhance the quality of the lake for habitat, fishing, camping, and other forms of recreation. The purpose of the proposed forebay is to capture sediment before it enters the restored lake. The forebay is intended to increase the functional effectiveness of the proposed aquatic habitat features, and extend the period before sediment cleanout is again necessary. The purpose of the proposed roadway is to improve access to the lake and other features within the park. The applicant has proposed a general mitigation concept plan. The mitigation concept plan identifies several existing tributaries within Broemmelsiek Park that may have potential for mitigation restoration. These tributaries also drain to Kraut Run/Dardenne Creek. The exact configurations and quantities of the mitigation restoration areas are as yet undetermined, and would require approval from the St. Louis District prior to acceptance.
P-2797: The applicant, Jeff Martin, True Manufacturing, seeks authorization to impact 1,570 linear feet of four ephemeral streams and 2,627 linear feet of an intermittent stream to construct a 34.5 acre recreational lake. Of this total, 932 linear feet of the unnamed tributaries will be filled to construct the dam and an additional 3,265 linear feet will be inundated with water. The purpose of the project is to provide a recreational opportunity located close to the existing on-site private lodge and to provide estate planning requirements relative to the future ownership of the property. The project area is near Valley Trails Lane, south of Highway D, southwest of New Melle. More specifically, it is located in Section 4, Township 45 North, Range 1 East, St. Charles County, Missouri. The unnamed tributaries flow into Callaway Creek, which flows to Femme Osage Creek, a primary tributary to the Missouri River. The public notice comment period opens June 6 and closes June 27, 2011.
P-2791: The applicant, Unimin Corporation, seeks authorization to conduct grading and filling operations in jurisdictional waters of the United States. The project plans include placing overburden material from the existing quarry into the subject tract. The overburden material is to be dumped and pushed into the ravine where the jurisdictional streams are located. Approximately 330,000 cubic yards of overburden material is to be displaced at this location. The project site currently exists as an undisturbed forested tract. Located within the tract are five ephemeral stream segments, one intermittent stream segments and a non-jurisdictional emergent wetland. The applicant requests approval to fill in 62 linear feet of Stream 1A, approximately 625 linear feet of Stream 1, and approximately 160 linear feet of Stream 2. Total stream impacts would include 847 linear feet. The project is located north of Hwy Z and east of Kerkoff Road, in the City of Pevely. More specifically, the project is located in Section 22, Township 41 North, Range 5 East, Jefferson County, Missouri. The public notice comment period opens May 18 and closes June 7, 2011.
P-2796: The applicant seeks authorization to impact 18.87 acres of emergent wetland to modify the property for flood management and water control. The impacted wetlands drain to the west to Peruque Creek and to the northeast to an unnamed tributary to Peruque Creek. Peruque Creek is a primary tributary to the Mississippi River. The property is approximately 163.23 acres and contains a bermed lake, small interior levees, and multiple culverts and pump stations. The property is currently used for agricultural practices and recreational duck hunting. The project will consist of a ring levee, multiple borrow ditches, a rock dike, and multiple drainage control structures. The ring levee will be approximately 6 - 7 feet tall (built to an elevation of 436.5) and will have a crown width of 10 feet. Excavated borrow ditches and drainage control structures will be installed as needed to drain the property and maintain control of water levels within the ring levee. A rock dike will be built along the east side of Peruque Creek Road as a requirement of St. Charles County to prevent erosion and gravel loss on the roadway. The applicant has reviewed alternatives to impacting the wetland and has minimized the width of the levee and total impact by reducing the crown width of the levee. In order to offset this impact to the wetland the applicant is currently reviewing on site mitigation options as well as purchasing mitigation bank credits. The project is located at 1230 Peruque Creek Road, in unincorporated St. Charles County, Missouri. The site is located within Township 48 North, Range 3 East, Section 35; using NAD83 the site is located at longitude -90.473 and latitude 38.935.
P-2795: The Corps of Engineers seeks authorization to discharge approximately 300 yards of material into the Mississippi River in conjunction with rehabilitating mooring features at the Corps of Engineers Service Base in St. Louis County, Missouri. P-2792: The City of O'Fallon, St. Clair County, Illinois seeks authorization to fill approximately 945 ft of a tributary of Ogles Creek, a tributary of the Kaskaskia River. The purpose of the project is for the reconstruction of Venita Drive, the relocation of Taylor Road and the construction of the CSMT Railroad overpass structure. The applicant proposes to mitigate the impacts by tree planting, stream protection and preservation of approximately 2.57 acres within the City Family Sports Complex Public Park, O'Fallon Parks and Recreation Department. P-2794: The applicant, Alan Bornstein for THF Bear Creek Development, L.L.C, seeks authorization to impact approximately 1,459 linear feet of ephemeral and intermittent streams to facilitate the development of a retail site in the City of Wentzville. The proposed retail structure includes associated outlots, access, and stormwater features as well. The purpose of the project is to develop a retail store with easy access and visibility from an existing major retail development (Wentzville Crossroads Marketplace) to serve retail needs of the local population. The project is located in Section 23, Township 47 North, Range 1 East, St. Charles County, Missouri. The unnamed tributaries ultimately flow to the Cuivre River, a primary tributary to the Mississippi River. The public notice comment period opens May 12 and closes June 2, 2011.
P-2793: Christ Bros Asphalt, Inc. has submitted an application for a section 404 permit to fill 6.3 acres of wetland adjacent to Little Silver Creek in Lebanon, IL. The purpose of the fill activity is to expand their asphalt and concrete crushing/recycling and manufacturing plant. The applicant proposes to mitigate by purchasing credits at an approved mitigation bank. Little Silver Creek is a secondary tributary to the Kaskaskia River. The public notice opens April 29, 2011 and closes May 16, 2011.
P-2790: The applicant, Jeromy Fritz, seeks authorization to impact approximately 10 acres of forested wetland located in the floodplain of the Meramec River to develop practice football fields for the Jefferson County Youth Association. The applicant proposes to mitigate for the wetland impacts by preserving the remaining 5 acres of forested wetland at the southern end of the property. Additionally, the land adjacent to the proposed project site is available for forested wetland preservation. The project area is located off of Bradley Beach Road in the City of Arnold, Missouri. More specifically, in Section 16, Township 43 North, Range 6 East, Jefferson County, Missouri. The public notice comment period opens April 12 and closes May 3, 2011.
P-2787: Peabody Gateway North Mining, LCC has proposed the Gateway North Mine an underground mine utilizing the room and pillar method to extract coal from the Herrin No. 6 Coal Seam for an underground shadow area of 16,489.6 acres. Mine entry development would include the construction of the slope, ventilation shafts, conveyor systems, coal and soil stockpiles, and a level pad for personnel parking and bath houses. Construction of the Gateway North Mine is proposed to begin in 2012, with operational capability beginning in 2014. Anticipated annual production is 4.8 -7.2 million raw tons from the Herrin No. 6 Coal Seam. Full production capability is anticipated by 2016. The Gateway North Mine is a new underground mine proposed to supply carry-on tonnage to the customers after the existing Gateway Mine closes.
The coal reserve would be mined utilizing two to three continuous mining sections. The coal would be transported by conveyor to the surface where it would be dumped into a surge bin. It would then either be temporarily stacked in the coal stockpile or continue by an overland conveyor approximately 2.0 miles to the existing Gateway Mine preparation facility. The Gateway Mine is an active, existing underground mine. The Gateway North Mine would be a new underground mine supplying carry-on tonnage to customers after the existing Gateway Mine closes. The two mines would co-exist for approximately 6 to 8 months.
The mine entry facilities would be primarily constructed on existing agricultural fields with some disturbance for utility and maintenance shafts in a small wooded area. The overland conveyor system would be constructed across a mixed area of agricultural fields and forested areas before crossing a section of the Union Pacific rail line before angling to the coal stock piles at the Gateway Mine near its existing coal preparation plant.
The purpose of the proposed disturbances is to develop the surface facilities required for the new underground coal mine to produce bituminous coal that would contribute to the continued power production within this nation. The activities associated with the mine entry development and overland conveyor would involve the proposed disturbance of wetlands and streams for a period from approximately 2012 to 2036. The Section 404 permit, if issued, would be authorized for the anticipated life of the project until 2036.
Stream assessments and wetland delineations were conducted by Wetland Services, Inc. from Corydon, Kentucky on approximately 25 wetland and 20 stream areas in the South Fork Mud Creek and Lick Branch-Marys River watersheds. The proposed activity would impact a maximum of 4.71 acres of forested wetlands, 0.02 acre of scrub-shrub wetlands, 3.71 acres of emergent wetlands and a total of 3,297 linear feet of ephemeral streams and 2,897 linear feet of intermittent streams. The streams in the Gateway North project area are unnamed tributaries to either Marys River or South Fork Mud Creek, both ultimate tributaries to the Mississippi River. All of the streams in the permit area would flow to open waters before outletting into their receiving stream. The streams in the northern 1/3 of the surface effects area flows to the Coulterville Reservoir with the remaining streams flowing to a freshwater lake constructed for the coal preparation plant at the existing Gateway Mine. The applicant evaluated different alternatives and stated no alternatives to the planned disturbance are available without leaving a large volume of high-quality coal reserve and additionally incurring large avoidance costs. P-2785: The applicant, Mr. Kenny Foeste, seeks after-the-fact permit authorization to allow for concrete pipes, soil, and rubble to remain within a jurisdictional water of the United States. The unauthorized activity was confirmed on December 8, 2009 and a Notice of Violation was issued on January 19, 2010, stating that the project is in violation of Sections 301 [33 U.S.C. 1311] and 404 [33 U.S.C. 1344] of the Clean Water Act (CWA). The unauthorized activity specifically resulted in the entombment of 350 linear feet of unnamed intermittent tributary into twin concrete pipes. A soil and rubble mix has been placed over the piped channel with the intent of creating a level ground surface to build upon. If an after-the-fact permit authorization is granted, the pipes and fill will remain within the jurisdictional tributary and will provide the necessary authorization for the applicant to complete the site grading and commercial development. The unnamed intermittent tributary flows directly into Juden Creek, which is a primary tributary to the Mississippi River. The project is situated at the intersection of State Highway 177 and Old Route V (CR 657) in Cape Girardeau County, Missouri. The public notice opens March 15, 2011 and closes April 5, 2011.

P-2784: American Milling, L.P. seeks authorization under Section 10 of the Rivers and Harbors Act to construct a pipe pile supported conveyor, loading tower and to permanently moor two captive dock barges. Approximately 14, pipe dolphins structures and an upstream and downstream pipe piling support structure will be driven to the point of resistance within the Mississippi River substrate to support an approximate 400-feet-long conveyor and loading tower for the transfer of dry bulk materials. Two captive dock barges would be installed along the upstream and downstream side of the loading tower. The two captive dock barges would measure 35-feet-wide by 195-feet-long. The barges would be permanently moored to the proposed pipe dolphins. Cargo barges would be delivered to the site for loading to the outside of the proposed captive dock barges. The delivered cargo barges would arrive as empties, be loaded, and then switched as loads to other existing fleets for shipment. The terminus of the proposed conveyor/loading tower and the riverward side of the proposed captive dock barges would not extend further riverward than the existing Arsenal Island mooring line. As such, the proposed operation isn’t expected to hinder or impede navigation that already passes the mooring line of the Arsenal Island fleets. The activity site is located along the left descending bank of the Mississippi River, at approximate river mile 175.66, near Cahokia, in St. Clair County, Illinois.
GP-34M - In accordance with Title 33 CFR 325.2 and 325.7(e), as published in the November 13, 1986, Federal Register, the Kansas City District, U.S. Army, Corps of Engineers (as lead district), in conjunction with the St. Louis District, Rock Island District, Little Rock District, and Memphis District (map enclosed) proposes to reissue General Permit 34 Missouri (GP-34M) which would authorize the discharge of dredged or fill material in association with excavation of sand and gravel in waters of the United States within the State of Missouri. This general permit would be reissued under the authority of Section 404 of the Clean Water Act (33 USC 1344) and Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403). The general permit was originally issued December 18, 1995, reissued on March 16, 2001, and again on December 22, 2005 and expired on December 31, 2010. In the preceding 5-year period, there were a total of 19 actions authorized under the provisions of this general permit in the St. Louis District.
P-2778: The applicant, U.S. Army Corps of Engineers, St. Louis District, seeks authorization to conduct grading and construction in conjunction with the Ted Shanks Conservation Area (TSCA) Habitat and Rehabilitation Enhancement Project (HREP). The HREP improvements will restore and enhance the quality and diversity of wetland habitat that in turn will primarily benefit migratory birds and secondarily other wetland species. Three objectives and enhancement measures are considered in detail to achieve the project goal: 1. Improve water level management, 2. Increase quantity of bottomland and floodplain forest, and 3. Improve aquatic habitat. To meet the objectives, the project includes the construction of new water control structures, degradation/setback of levees, restoration of channels, construction of rock riffle and hard point structures, construction of berm segments to divide the area into three management units, construction of channel for the proposed pump station and planting of bottomland hardwoods and floodplain forests. The applicant has been working on alternatives, avoidance and minimization in conjunction with the Missouri Department of Conservation. To off-set the impact to aquatic resources, the proposed project will enhance and restore over 2900 acres of wetland habitat through the construction of this project. Additionally, the applicant proposed approximately 296 acres of tree planting to compensate for the tree clearing associated with construction. The proposed project is located on the right descending bank of the Mississippi River, adjacent to the town of Ashburn, Missouri in Pike County. The project area encompasses part of TSCA and the Upper Mississippi River Conservation area. It lays in Pool 24 between Upper Mississippi River Miles (RM) 284.5 and 288.5. The public notice comment period opens on January 13 and closes February 3, 2011.
P-2776: The city of Frontenac has applied for a Section 404 permit to conduct channel modifications to Monsanto Sunswept Creek. The modifications are proposed to alleviate residential flooding associated with stormwater runoff. Approximately 500 linear feet of channel will be impacted. The modifications generally consist of channel widening, as well as the installation of vegetated gabion baskets, stone toe revetment, and block wall. The purpose of adding the new dock barge is to allow year-round usage of the facility during low river stages. The activity site is located at Italgrani USA's existing river terminal operation at 7900 Van Buren Street, in St. Louis, Missouri, along the right descending bank of the Mississippi River at approximate river mile 172.5. P-2774: The applicant, Charah, Inc., seeks authorization to conduct grading and filling operations within jurisdictional waters of the United States to develop the project area into a multi-use retail/commercial development. The proposed project includes the use of approximately 1 to 1.25 million cubic yards of Class C fly ash to assist in raising the project area to a desired elevation of 610 feet National Geodetic Vertical Datum. The fly ash is proposed to be obtained from the AmerenUE Rush Island power plant. The Missouri Department of Natural Resources - Solid Waste Management Program (MDNR-SWMP) guidance for beneficial use of fly ash allows the use of medium to large quantities of fly ash to bring construction sites to the desired grade to build buildings upon as well as other associated infrastructure. The waters of the United States situated on the project area are proposed to be filled with a geo-composite clay that will serve as a liner beneath the fly ash. The waters of the United States to be filled with the clay include; approximately 1,196 linear feet of intermittent Tributary A, 203 linear feet of ephemeral Tributary B, and a 0.10 acre emergent wetland. Tributary C will be piped for its entire 383 linear feet beneath the clay liner. The project area is located in Section 13, Township 40 North, Range 5 East, in the City of Festus, Jefferson County, Missouri. The public notice opens October 29, 2010 and closes November 29, 2010.
P-2773: The applicant, Metropolitan St. Louis Sewer District, seeks authorization to conduct grading and filling operations within a jurisdictional water of the United States. The proposed project includes stabilizing several sections of eroding streambanks along an unnamed tributary to Two-Mile Creek. The eroded banks are impacting private residential properties, contributes to public safety concerns and threatens to impact an existing sanitary sewer line. P-2772: The applicant, Metropolitan St. Louis Sewer District, seeks authorization to conduct grading and filling operations within a jurisdictional water of the United States. The eroded banks are impacting an existing sewer line, contributing to increased sediment load within the watershed and have posed public safety concerns. The Wenneker project includes the installation of approximately 451 linear feet of the plantable segmented retaining wall. Project impacts include new impacts and replacement of existing impacts. P-2771 - The applicant seeks authorization to reconstruct IL Rt. 13 to provide a six-lane roadway section separated by a grass median from Division Street in Carterville to Halfway Road in Marion. There are seven identified wetland sites impacted for a total of 1.48 acres. In addition, there are stream crossings of Pigeon Creek, Westernairre Creek and an unnamed creek that involve the extension of existing box culverts. Also, a box culvert will be installed on Pigeon Creek for the new Frontage Road and Bike/Ped trail. The mitigation will occur off-site at the approved Sugar Camp Creek Wetland Mitigation Bank. Mitigation will total 5.98 acres of compensation consisting of 4.8 acres of floodplain forest and 1.2 acres of wetland meadow. Pigeon Creek is a secondary tributary to the Big Muddy River.
P-2770: The applicant seeks authorization to impact approximately 1295 linear feet of jurisdictional stream for the overall purpose of improving the Metro rail alignment south of the UMSL South Station. These improvements include an interlocking, rail cross-over. The basic project purpose is for erosion control and track embankment stabilization for public safety. The project is located within the right-of-way of Metro along the westbound track (Track No.1) adjacent to the Glen Echo Golf Course in St. Louis. P-2769: The applicant seeks authorization to impact approximately 1825 linear feet of jurisdictional stream in order to construct a private, recreational lake. Approximately 200 linear feet of stream will be impacted to construct an earthen dam and the remaining 1625 feet of stream will be inundated with water to form a 12-acre lake. P-2768: The applicant, Terra Foundation, Inc. has submitted a prospectus to establish a statewide In-Lieu Fee (ILF) mitigation program within the State of Missouri. The proposed ILF program would operate throughout the State of Missouri. This Public Notice (PN) applies to the entire State of Missouri, including those areas of the state in the Kansas City District, St. Louis District, Memphis District, Little Rock District, and Rock Island District. P-2766: The applicant seeks authorization to improve the safety of those travelling on Baumgartner Road by realigning an approximate ½ mile section of Baumgartner Road from Blackforest Drive to north of Fireleaf Drive and reconstructing the intersections of Baumgartner/Old Baumgartner, Baumgartner/Blackforest, Baumgartner/Fireleaf and Old Baumgartner/ Milburn Road. The project would include installing dedicated turn lanes and traffic signals at critical intersections and installing sidewalks to meet Americans with Disabilities Act (ADA) requirements. The project would also include adding detention basins, open swales, and other permanent stormwater Best Management Practices (BMP) to manage sediments, debris, and other roadway contaminants to improve stormwater quality before it is discharged from the new roadway and surrounding areas.
P-2764_2765: The applicant seeks authorization to modify P-2577, by continuing periodic maintenance, but by placing dredged material into the river just outside the harbor entrance at river mile 221.5. P-2576 previously authorized the expansion of the harbor by digging out a new area 250 feet wide and 300 feet long. After issuance of the permit, it was revealed that the proposed 250x300 feet would be inadequate to accomplish the project. Since the applicant could not accomplish the goals of the project as authorized, the applicant never proceeded with the work. Under P-2564 the applicant now wishes to proceed with the project by altering the original proposal to construct an area 250 feet wide and 480 feet long. The area, which was authorized to be approximately 1.72 acres in size excavated out of non-jurisdictional areas, is now proposed to be 2.75 acres in size. P-2767: MVS-2010-488: The U.S. Army Corps of Engineers, St. Louis District proposes the completion of design deficiency corrections for the East St. Louis, IL Flood Protection Levee System, also known as the MESD and Chain of Rocks Levee systems. The activities are proposed in accordance with measures recommended by the U.S. Army Corps of Engineers who believe that the levee system has significant underseepage problems and possible other problems. As such, the Corps cannot certify that the levee system will protect against a 100-year flood. The U.S. Army Corps of Engineers, St. Louis District Project Management Branch announces the availability of the Design Deficiency Corrections East St. Louis, IL Flood Protection Project Environmental Assessment (EA) and Finding of No Significant Impact (FONSI). The purpose of the EA and FONSI is to present a detailed proposal for the significant underseepage problems and possible other problems along the MESD and the Chain of Rocks levee systems. Seepage under a levee and through a levee can be controlled by a variety of measures. Seepage through the main aquifer under a levee can be controlled by landside relief wells, seepage berms (generally landside), slurry trench cutoff walls (generally near the riverside levee toe or at the levee centerline), and measures to increase the distance between the levee and the point where flood water is introduced to the aquifer. The tentative recommended plan for underseepage and through-seepage controls for a flood at 54 ft on the St. Louis gage (design flood at 52 feet on the St. Louis gage plus 2 feet of freeboard) consists of the lowest cost alternative for most decision segments and new alternatives for certain decision segments that were identified prior to and during a subsequent value-engineering study.
P-2758: The applicant proposes to conduct clearing and gravel removal operations in waters of the United States to prevent future flooding within the City of Steelville, Missouri. The City of Steelville proposes to clean out an approximately 900 linear foot section of Yadkin Creek, which flows into Whittenburg Creek, a primary tributary to the Meramec River. The proposed creek clearing is to be conducted with a bulldozer and/or backhoe. The City would like to remove the gravel bars and vegetation that has built up within the creek. P-2762: Knight Hawk Coal Company seeks authorization under Section 404 of the Clean Water Act to impact 21, 149.6 linear feet of numerous unnamed ephemeral and intermittent reaches of an unnamed tributary to Little Mary's River in association with the construction activities related to the development of Hawkeye Mine. In addition 6.54 acres of wetlands will be filled as a result of the project. The applicant proposes to mitigate by replacing a tributary at its original location, providing the establishment of 150 foot corridors on each side of intermittent channel and 50 foot corridors on each side of ephemeral channels as well as planting a diverse mix of bottomland tree species native to the region. A final cut impoundment totaling 6 acres of open water will also be constructed. Little Mary's River is a tributary to the Mississippi River. The project is located approximately 2 miles southwest of Sparta, Randolph County, Illinois.
P-2761: The City of Pinckneyville seeks authorization to fill approximately two acres of forested wetland which may be sold for commercial development. The applicant proposes to mitigate off-site by restoring 6 acres of prior converted cropland to forested wetland. The wetlands are along the unnamed tributary which flows into Beaucoup Creek, which drains into the Big Muddy River, a primary tributary to the Mississippi River. The project is located northwest of the intersection of State Route 13 and Mildred Drive in Pinckneyville, Illinois.

P-2759: MVS-2010-380: Consolidated Grain & Barge Co. (CG&B) seeks authorization to dredge approximately 4,000 cubic yards of accumulated sediment and sand from beneath their work barge LOB 132 at their Birds Point Terminal. All dredged material will be removed by means of a crane and clam shell from a temporary work barge. The dredge material will be deposited back into the Mississippi River system allowing it to re-enter natural littoral drift patterns, downstream of the terminal. Due to fluctuation in river levels, Consolidated Grain & Barge Co. seeks a 5-year permit authorization to allow adequate time to complete the proposed work. Dredging activities would occur along the existing Consolidated Grain & Barge Company's, Birds Point Terminal Dock facility. This facility is located along the right descending bank of Mississippi River, at approximate river mile 2.4, approximately 4 ½ miles northwest of Wilson City, Mississippi County, Missouri.
P-2757: The applicant proposes to conduct bed and bank stabilization activities within Knolls Creek, a primary tributary to Dardenne Creek. Approximately 4,700 linear feet of channel will be stabilized using a combination of hard armoring and biostabilization. The proposed stabilization includes 14 vertical grade control structures, 1,190 feet of stabilization on the left-descending (eastern) bank, and 2, 170 linear feet of stabilization on the right-descending (western) bank. Approximately 620 linear feet of overlap occurs between the stabilization on the right-descending and left-descending banks. In conjunction with the stabilization, a pedestrian trail will be constructed through the project corridor. The pedestrian trail will require two creek crossings. Portions of the project corridor are located within a mitigation stream preservation area. The proposed stabilization, as well as the creek crossings, would impact the preserved mitigation area. P-2756: U.S. Silica Company wishes to expand their existing quarry to create sufficient silica reserve capacity for future demands. Approximately 1515 linear feet of channel will be impacted by the proposed activity. The project is located within the property limits of U.S. Silica Company immediately north of Highway 66 Business Loop in the City of Pacific, St. Louis County, Missouri. Three unnamed ephemeral tributaries and one perennial stream, named Clear Creek, will be impacted by this project. These waterbodies flow into the Meramec River. The Public Notice comment period opens on May 14, 2010 and closes on June 4, 2010.
P-2755: The applicant seeks authorization to impact approximately 1,400 linear feet of the left and right descending banks of an unnamed tributary to Black Creek. The unnamed tributary flows to Black Creek which is a perennial tributary to the Mississippi River. The channel in this area is approximately 4 - 5 feet wide with 3 - 6 foot high banks. The banks of the unnamed tributary are proposed to be stabilized by using angular rock fill. Township 45 North, Range 6 East, Section 5. The project area is located approximately 500 feet to the west of, and parallel to, Price Lane between Paxton and Ricardo Lanes in Ladue, Missouri. Residential development borders the site on all sides. The area of impact occurs along the east and west banks of the unnamed tributary.
Special Public Notice: Pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S. Code 403) and Section 404 of the Clean Water Act (33 U.S. Code 1344), notice is hereby given that the US Army Corps of Engineers Districts in the State of Illinois have developed guidance for making a determination of credits for projects that require stream mitigation within the State of Illinois. The US Army Corps of Engineers Districts in the State of Illinois, Illinois Environmental Protection Agency, and Illinois Department of Natural Resources will be testing the Illinois Stream Mitigation Method for 6 months from the date of this notice and will make any modifications to the method at the end of this test period. It is anticipated that any modifications to the method following the testing will be completed by November 2010. Stream mitigation guidance described in the attached document is designed to supplement mitigation plan requirements in the Mitigation Rule released on April 10, 2008 (Compensatory Mitigation for Losses of Aquatic Resources). Specifically, this method addresses the requirements for making a determination of credits identified in Section 332.4 (c)(6) of the Mitigation Rule. This method is considered a part of an overall mitigation plan and does not replace any other mitigation plan requirements or components identified in the Mitigation Rule.
P-2753: The Missouri Department of Transportation (MoDOT) has submitted a Mitigation Banking Prospectus to restore, establish, enhance and permanently protect 25.4 acres of wetland and 24.81 acres of riparian forest. If approved the Mitigation Bank would serve as a compensatory mitigation option for MoDOT to fulfill permit conditions under Section 404 of the Clean Water Act and MDNR's Section 401 Water Quality Certification Program. The Mitigation Bank is proposed along Bear Creek which is a tributary to the North Fork Salt River, which flows into Mark Twain Lake. The proposed mitigation bank is located in Macon County, Missouri. The public notice opens April 12, 2010 and closes on May 12, 2010.
P-2748, P-2749 and P-2450: The applicant proposes to establish three barge fleeting facilities along the left descending bank of the Mississippi River, in St. Clair County, Illinois. Two of the fleeting areas (King Fleet #1 and King Fleet #2) are proposed upstream of the Martin Luther King Bridge, at River Mile 180.5. The third fleeting area (Queen Fleet #1) is proposed downstream of the Eads Bridge at River Mile 180. The public notice comment period opens on March 29, 2010 and closes on April 19, 2010. Special Public Notice: IL GP-16 RENEWAL: Rock Island District in association with all other Corps Districts who regulate waters of the U.S. in Illinois , request authorization to renew Illinois Regional Permit 16 for work in Illinois waters associated with Bank Stabilization Activities. The public notice comment period opens on March 25, 2010 and closes on April 23, 2010.
